These terms and conditions (the Terms) are the terms on which we supply the products available through our website (the Products) to you. You can find everything you need to know about us, and our Products on our website prior to placing your order.
Changes to these Terms, our Products and pricing
We may revise these Terms at any time by amending this page. We recommend you check this page from time to time to make note of any changes we have made, as they are binding on you if you place an order after such changes have been made. For the avoidance of doubt, changes to these Terms will not affect any orders placed before the changes were uploaded to our website.
All pricing listed on our website is subject to change and we reserve the right to change the pricing at any time without notice.
We are constantly updating and revising our Product catalogue and may discontinue a Product at any time without notice or liability to you.
We only accept orders when we've checked them
We will contact you to confirm we've received your order and then we contact you again to confirm acceptance and dispatch of your order.
Please note that when we confirm receipt of your order, this does not signify our acceptance of your order. We reserve the right at any time after receipt of your order to accept, reject or limit your order for any reason, and each order is always subject to availability and our acceptance which will be confirmed to you upon dispatch.
Sometimes we reject orders
Sometimes we reject orders, for example, because a product is unexpectedly out of stock, because we were unable to obtain authorisation for payment, or because the product was mispriced by us.
When this happens, we will let you know as soon as possible and refund any sums you have paid for in the original form of payment. Where you have submitted an order using a site credit that we have issued, on rejection of your order, your site credit will be available for you to reuse immediately upon such rejection. Any applicable promotions will be refunded and reactivated in your account, as long as the promotion is yet to expire.
We charge you when you order
Where you select to make a card payment for a product (rather than applying a site credit), payment will be debited from your card when your order is placed. However, if we subsequently reject your order after you have placed it, any sums you paid will be promptly refunded to you.
All orders are subject to verification for security reasons. You will have 48 hours to complete the verification process once you have been contacted via email. If you do not respond after such time, we may reject your order.
Once we have accepted your order, and we have received payment in full, we will arrange for dispatch of the Product(s) you have ordered from our warehouse.
All website payments are processed in GBP. Payments made from non-UK debit or credit cards will be calculated using currency conversion by Shopify on the day of the transaction. You agree that we are not responsible for any credit shortages due to currency conversion rates.
You must keep your account details safe
When placing an order for the first time, you may be offered the option or may be required to register an account with us and complete certain required fields on the order form. If we ask you to provide, or you are provided with, a user identification code, password, or any other information or user identifiers as part of our security procedures, you must treat such information as confidential and you must not disclose it to any third party.
We have the right to disable any account at any time if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.
You must promptly notify us at hello@16arlington.co.uk if you become aware of or suspect any unauthorised use or access of your account or account details.
We accept the following methods of payment
The website shall provide for the following payment methods: Visa, MasterCard and American Express.
We're not responsible for delays outside our control
If your order is delayed by an event outside our control, we will contact you as soon as possible to let you know and do what we can to reduce the delay. As long as we do this, we won't compensate you for the delay, but you can contact our Customer Service Team by emailing hello@16arlington.co.uk to end the contract and receive a refund for any products you have paid for, but not yet received. This does not affect your statutory rights as detailed below.
Products can vary slightly from their pictures
We have taken care to describe and portray our Products as accurately as possible on our website. However, Products which you buy from our website may differ slightly from their photographs. The images on our website are for illustrative purposes only and this means that the Products you purchase may vary slightly from those images. A product's true colour may not exactly match that shown on your device or in our marketing, or its packaging may be slightly different.
The price of our Products (including any applicable VAT) will be the price indicated on the check out page when you place your order (excluding any customs duties or other charges that may be payable in your delivery location).
Although we try to make sure that the prices shown on the website and check out page are accurate, some of the prices may be incorrect. If we find a mistake in the price of any Product you have ordered, we will not be able to accept your order and will contact you to give you the option of continuing your order (at the correct price) or cancelling the order and receiving a refund. If we are unable to contact you, we will treat your order as cancelled.
Minor changes to your order
We may change the Products you order:
1) to reflect changes in relevant laws and regulatory requirements; and/or
2) to implement minor adjustments and improvements.
In addition to the above, we may make more significant changes to the Products you order, but if we do so we will notify you and you may then contact us to end the contract and receive a refund before any such changes take effect.
You may be able to pre-order items
You can pre-order new season Products on the website and make payment in advance.
When you pre-order Products, we will provide you with estimated shipping dates. If your order includes both in-stock and pre-order Products, or you purchase multiple pre-order Products with different estimated shipping dates, items will be despatched to you as they arrive at our warehouse, however you will only be charged a single shipping charge.
When a Product has been dispatched, you will receive shipping confirmation so you can track your order. The estimated delivery date will also be available to view on the Products page in your online account.
Where do we deliver to
We deliver worldwide except to Russia.
For deliveries within the UK, the price is inclusive of VAT. For deliveries outside the UK, the price remains the same, but VAT is not charged, and you will not be entitled to VAT refunds.
Shipments within the UK do not have customs or import duties.
We now cover duties and import taxes for Saudi Arabia, France, Kuwait, Cyprus, Italy, Australia, Sweden and Spain. Whilst we cover customs and duties in USA and Canada, local taxes may be added at checkout.
Shipments outside the UK, Saudi Arabia, France, Kuwait, Cyprus, Italy, Sweden, Spain, USA, Canada or Australia are not inclusive of any customs, import duties or taxes, and these could be levied once the shipment reaches its destination country. These charges must be paid by you as the recipient of the shipment and may also create delays in your delivery. Unfortunately, we have no control over these charges, and cannot tell you what the cost would be, as customs policies and import duties vary widely from country to country.
When will I receive my order
Shipping charges and delivery times will depend on what option you choose for shipping and where your order is set to be shipped.

For shipments to other countries, our standard shipping method will depend on the country in question. Please check the DHL international shipping method by country.
We will try to deliver your order according to the timescales indicated, but very occasionally things can go wrong that are outside our control. In this case, let us know as soon as you are aware of an issue, and we will aim to resolve it as soon as possible. The longer you wait before letting us know that your order has not arrived, the harder it is for us to trace your shipment and try to resolve the delay. Even though we will try to resolve the issue, we are not responsible or liable to you for any delays to your order.
You are responsible for the Products once we deliver your order to your delivery address.
Where is my order
We deliver with DHL for the UK and DHL, UPS and FedEx on all international orders. All orders will be shipped to the delivery address indicated by you at the time of purchase. Once your order has left us, the carrier will retain full responsibility for the shipment. For any lost shipments, international duty charges or damaged shipments, please get in contact with the carrier directly where a claim may be filed.
How can I make a return?
We are pleased to accept timely returns within 15 days from the date you received your order.
Please note the following in relation to returns:
- All items must be returned unused and in their original branded packaging with all seals and labels intact
- When returning your order, please ensure you obtain proof of postage with tracking information as we are not responsible for any loss or damage to the product when it is being sent to us and the parcel is your responsibility until it reaches our warehouse
- We use DHL for the UK returns, and will deduct £15 from your total refund amount should you choose to return any product
- We use DHL, UPS and FedEx for all international returns and will deduct the price of shipping the product to our warehouse from your total refund amount; the amount we will deduct will depend on the country you are returning the products from
- Any returns outside the time limit specified above may not be accepted and you may not receive a refund; if a Product is returned outside the 15 day return policy, we may have to return this to you and ask you to cover the delivery costs
- If you handle the product in a way which would not be acceptable in-store, we reduce your refund, to compensate us for its reduced value. For example, we reduce your refund if the product's condition is not "as new", price tags have been removed, our product branded packaging is damaged, or accessories are missing. In some cases, because of the way you have treated the product, no refund may be due.
- Shoes must only be tried on over a carpeted surface to prevent any scratches to the sole and all shoes must be returned with their original shoe box. We reserve the right to reduce your refund to compensate us where shoes returned without the original box, in a damaged box or where the shoes show signs of wear and tear
- Please also note that you cannot return any orders for Products sealed for health protection or hygiene purposes once these have been unsealed after receipt, goods made to your specification or clearly personalised, and goods which have become mixed inseparably with other items after delivery

International returns (outside the UK)
Visit our International Returns portal HERE and input your order number with a 3 at the start and the email address you used to place your order. Your order number is included on your returns slip and is 4 digits long. Follow the rest of the online instructions in the portal, selecting the Product(s) you wish to return. Please follow the instructions in these terms, and also include your returns slip with your order when placing the return.

When and how we refund you
We will issue a refund as soon as practicable and will try to refund you within 14 days of your return arriving at our warehouse. You have the option to be reimbursed by way of site credit or by the same method you used for payment. Please be aware that your chosen payment provider may take additional time to credit the refund.
You have rights if there is something wrong with your product
If you think there is something wrong with your Product, you must contact our Customer Services Team by emailing hello@16arlington.co.uk. We honour our legal duty to provide you with products that are as described to you on our website and that meet all the requirements imposed by law.
Summary of your key legal rights The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following: · Up to 30 days: if your goods are faulty, then you can get a refund. · Up to six months: if your goods can't be repaired or replaced, then you're entitled to a full refund, in most cases. · Up to six years: if your goods do not last a reasonable length of time, you may be entitled to some money back. |

We can suspend the supply of a Product
We may do this to:
- deal with technical problems or make minor technical changes;
- update the product to reflect changes in relevant laws and regulatory requirements; or
- make changes to the product.
We will contact you in advance to tell you we're suspending your order, unless the problem is urgent or an emergency. If we suspend the order, we will adjust the price so you don't pay for it while its suspended. If we suspend supply, or tell you we're going to suspend supply, for more than 4 weeks you can contact our Customer Service Team by emailing us at hello@16arlington.co.uk to end the contract and we'll refund any sums you've paid in advance for products you won't receive.
WE DON'T COMPENSATE YOU FOR ALL LOSSES CAUSED BY US OR OUR PRODUCTS
We're responsible for losses you suffer caused by us breaking this contract unless the loss is:
- Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).
- Caused by a delaying event outside our control. As long as we have taken the steps set out in the section of these terms: 'We're not responsible for delays outside our control'.
- Something you could have avoided by taking reasonable action, including following our reasonable instructions for use.
- A business loss. It relates to your use of a product for the purposes of your trade, business, craft or profession.

Our price adjustment policy
We will honour price adjustments on Products purchased within a 14-day period prior to the start of a sale. Please note that the Product has to still be available on the site in the same size as originally purchased. We are only able to honour price adjustments at the initial markdown, and will not be able to honour any subsequent markdowns or changes in price, if any.
Contests and Promotions
On occasion we issue promotional codes, site credits, and similar gift certificates which will provide a credit towards a purchase on our website when redeemed at checkout. These codes are non-transferable and are to be used only by the intended recipient.
We reserve the right to cancel a promotion or reject redemption of a promotional code when the total value exceeds a certain value, generally the price of the item for which the code is being used.
Promotions are only eligible for full priced Products and are limited to one per transaction. Minimum spends may be required and will be communicated to you in each instance. Where a promotion has been communicated to you via email, the promotional code is always non-transferable, and the email address provided during checkout must be the same as the email address that received the promotional code.
All promotions have an expiration date which will be indicated to you in your online account or via the relevant communication. Once the promotion has expired, the amount may not be refunded. If the promotion is still active, it will be refunded to your account to be used towards a future order.
We will not be liable to you for any loss or damage arising out of a refusal, cancellation or withdrawal or a promotion or any failure or inability by you to use a promotional code for any reason whatsoever.
Promotional codes do not cover the costs of any shipping, customs, import duties and/or local taxes where these apply, which must be paid by you in each instance.

You have several options for resolving disputes with us
Our complaints policy. Our Customer Service Team: hello@16arlington.co.uk will do their best to resolve any problems you have with us or our products.
You can go to court. These terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.
Other important terms apply to our contract
We can transfer our contract with you, so that a different organisation is responsible for supplying your product. You can only transfer your contract with us to someone else if we agree to this.
These terms constitute the entire agreement and understanding between us concerning the subject matter.
Nobody else has any rights under this contract. This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.
If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.
Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you're not allowed to, but that doesn’t mean we can't do it later.
